C. Warranty
The Artist warrants that the work is free from defects in material and workmanship for a period of one (1) year from the date of delivery/shipment to the Purchaser. The finish or top coating on the work is expressly excluded from any such warranty. To assert a claim under such warranty, the Purchaser must notify the Artist in writing or email specifying the nature of the defect. The Artist may require the Purchaser to return the Work to the Artist’s place of business at the Purchaser’s expense before the Artist is obligated to honor the said warranty. The Purchaser is responsible for all shipping fees, crating, and insuring the Work to and from the Artist’s place of business. At the Artist’s option, the Artist may repair, replace without charge, or make fair allowance for any defects in material or workmanship.

a. The Artist will not be liable for any incidental or consequential damages, loss, or expenses arising in connection with the use of, or the inability to use, the Work for any purpose. The Artist’s liability is limited to making a replacement or allowance within a reasonable time after proper written notice. Under no circumstances will the Artist’s liability exceed the Total Purchase Price for the work claimed to be defective.

b. This is the Artist’s sole warranty concerning the customer goods; the Artist makes no other warranty of any kind whatsoever, express or implied, and all implied warranties of merchantability, fitness for a particular purpose, or otherwise are hereby disclaimed by the Artist and excluded.
